Privacy policy of MINROC Bohrausrüstungen GmbH

Protecting the personal data of the visitors to our website, our business partners and our employees is a key concern for us. We have therefore taken all technical and organisational measures to comply with the statutory data protection provisions (EU General Data Protection Regulation, German Federal Data Protection Act, German Telecommunications Digital Services Data Protection Act). Below we inform you about how we collect and use the data of visitors to our website, our business partners and our employees.

Your privacy matters to us. You should feel safe with us. We therefore make sure that the data protection requirements are met, in particular the European General Data Protection Regulation (GDPR), which has applied since 25 May 2018, and the German Federal Data Protection Act (BDSG).

As a rule, you can use our website without providing any personal data. Where personal data (for example name, address or email addresses) is collected on our pages, this is always done on a voluntary basis as far as possible. Data is only passed on to third parties in the cases described in this privacy policy.

Please note that data transmission over the internet (e.g. when communicating by email) can have security gaps. Complete protection of data against access by third parties is not possible.

We hereby expressly object to the use of the contact details published as part of our legal notice obligation by third parties for sending advertising and information material that has not been expressly requested. The operators of this website expressly reserve the right to take legal action in the event of unsolicited advertising, such as spam emails.

Entering your data on our website (e.g. in the contact form) is voluntary. We have taken technical and organisational measures to make data transmission as secure as possible. Nevertheless, no electronic communication is completely secure. This means that any data and information you voluntarily send to us could be obtained by third parties through unlawful means. Purpose and legal basis of data processing

You can be sure: we store your data in the central customer database of MINROC Bohrausrüstungen GmbH only to respond to your enquiries, to fulfil and process contracts (including payment processing) and for our own information and advertising purposes. The processing is based on the EU General Data Protection Regulation and the German Federal Data Protection Act.

If you send us an enquiry or conclude a contract with us, we process your personal data. Depending on the transaction, this includes your:

  • Surname, first name
  • Company name
  • Address
  • Email address
  • Date of birth
  • Telephone/fax number
  • Service
  • IP address
  • Bank details
  • VAT ID number and, where applicable, tax number

We store and process this data to fulfil and process the contract and for our own information and advertising purposes. To conclude a contract we need at least your surname and first name or company name and your address in order to identify you; for enquiries via the online portal we additionally need your email address, and for order communication and the provision of services also your address. Without this information, the respective enquiries or contracts cannot be fulfilled.

The IP address is only used where this is necessary to safeguard the legitimate interests of the controller or a third party, unless the interests or fundamental rights and freedoms of the data subject which require the protection of personal data override them (e.g. to pursue legal claims and to investigate criminal offences).

Only the employees of MINROC Bohrausrüstungen GmbH and, in the course of certifications or official inspections, the commissioned auditors/inspectors have access to the data in the central customer database of MINROC Bohrausrüstungen GmbH. The customer database is based on the legitimate interests of MINROC Bohrausrüstungen GmbH and makes it easier to comply with the data protection requirements regarding data accuracy and data portability. We have given sufficient consideration to your interests and fundamental freedoms.

Stored data

Server statistics automatically and unavoidably store the data that your browser transmits to us. This includes the browser type and version, the operating system used, the referrer URL (the previously visited page), the host name of the accessing computer (IP address) and the time of the server request. This data is stored solely for internal system-related and statistical purposes. As a rule, we cannot attribute this data to specific persons, and it is not merged with other data sources. Further personal data is only collected if you provide it voluntarily, for example as part of an enquiry.

Our website is hosted by IONOS SE, Elgendorfer Str. 57, 56410 Montabaur, Germany. IONOS processes the data mentioned above on our behalf on the basis of a data processing agreement (Art. 28 GDPR). The legal basis is our legitimate interest in the secure and stable operation of the website (Art. 6(1)(f) GDPR).

Cookies

Our website only sets technically necessary cookies: a session cookie that technically holds your visit together, and a security cookie (XSRF-TOKEN) that protects forms against misuse. Neither cookie contains any information about you, and both expire after 120 minutes. The legal basis is Section 25(2) no. 2 TDDDG in conjunction with Art. 6(1)(f) GDPR.

We do not set any cookies for analytics or advertising purposes. Only if you object to web analytics is an opt-out cookie stored (see “Web analytics with Matomo”). Videos and maps from Google are only loaded after you click (see below).

Contact form

If you send us an enquiry via one of the contact forms, we process the information you enter (e.g. name, company, telephone number, email address and your message) in order to handle your enquiry. The information is sent to us by email and is not stored in a database of the website.

To protect against spam, we check enquiries exclusively on our own server, without external services: using a form field that is invisible to humans, a minimum time to fill in the form and a limit of five enquiries per IP address within ten minutes. For this purpose, your IP address is only cached in encrypted (hashed) form for ten minutes. The legal basis is our legitimate interest in protection against abusive enquiries (Art. 6(1)(f) GDPR).

The legal basis is Art. 6(1)(b) GDPR where your enquiry relates to a contract or pre-contractual measures, and otherwise our legitimate interest in answering enquiries (Art. 6(1)(f) GDPR). We delete the information once your enquiry has been fully dealt with, unless statutory retention obligations apply.

Recipients of personal data

Within the scope of the statutory provisions, your personal data is disclosed to the following companies within the EU:

  • Postal service providers, freight forwarders, shipping service providers, file/data carrier disposal
  • IT service providers for maintenance and software support, and our hosting provider
  • Service providers for credit checks, debt collection and direct marketing
  • Service providers in the context of certifications/inspections

If you load videos from YouTube or the map from Google Maps, data may also be transferred to the USA. You will find details in the respective sections below.

Storage period

We store your data for as long as the respective purpose requires:

  • Accounting vouchers: 8 years, commercial books and annual financial statements: 10 years
  • Contract documents: 10 years
  • IP data: 3 years
  • Legal matters: 6 years, damage claims: 10 years

Where a commercial or tax retention period applies to certain data processed for the handling of purchase contracts, the storage period is 6, 8 or 10 years. During this time, the processing of the data is restricted. The retention period begins at the end of the calendar year in which the contract was fulfilled.

Rights of data subjects

MINROC Bohrausrüstungen GmbH fully guarantees your rights as a data subject.

Objection to advertising

You can object to the use of your data for advertising purposes without incurring any costs other than the transmission costs at the basic rates. You can use the contact details below for this.

Withdrawal of consent

You can withdraw your consent to the processing of personal data at any time with effect for the future. Please note, however, that you may then have to provide your data again before receiving a new offer. This also applies if you object to the further use of your data by MINROC Bohrausrüstungen GmbH.

Right to object

You have the right to object at any time, on grounds relating to your particular situation, to the processing of your personal data that is based on the following provisions:

  • The processing is necessary for the performance of a task carried out in the public interest or in the exercise of official authority vested in the controller (Art. 6(1)(e) GDPR), or
  • the processing is necessary for the purposes of the legitimate interests pursued by the controller or by a third party, except where such interests are overridden by the interests or fundamental rights and freedoms of the data subject which require protection of personal data, in particular where the data subject is a child (Art. 6(1)(f) GDPR).

If you object, we will no longer process your personal data unless we can demonstrate compelling legitimate grounds for the processing which override your interests, rights and freedoms, or the processing serves the establishment, exercise or defence of legal claims. This also applies to profiling based on these provisions.

Further rights

You have the following rights towards the controller with regard to your stored personal data:

  • Access
  • Rectification
  • Erasure or restriction of processing
  • Objection to processing
  • Data portability
  • Lodging a complaint with a data protection supervisory authority (responsible for us: the Hessian Commissioner for Data Protection and Freedom of Information)

Embedded YouTube videos

On some pages we embed videos from YouTube. The provider is Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland. The videos are only loaded when you click “Load video”; before that, no data is transmitted to YouTube. We use the privacy-enhanced mode (youtube-nocookie.com). After the click, YouTube receives, among other things, your IP address and the information which of our pages you visited, and may store cookies or similar technologies on your device. If you are logged in to YouTube, YouTube can assign this information to your user account. The legal basis is your consent given by the click (Art. 6(1)(a) GDPR, Section 25(1) TDDDG). Data may be transferred to Google LLC in the USA, which is certified under the EU-US Data Privacy Framework. We have no influence on the further processing by YouTube.

You can find further information in Google’s privacy policy: https://policies.google.com/privacy

Google Maps

On the “Directions” page you can load a map from Google Maps. The provider is Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland. The map is only embedded when you click “Load map”; before that, no data is transmitted to Google. After the click, Google receives, among other things, your IP address and may store cookies or similar technologies on your device. The legal basis is your consent given by the click (Art. 6(1)(a) GDPR, Section 25(1) TDDDG). Data may be transferred to Google LLC in the USA, which is certified under the EU-US Data Privacy Framework.

You can find further information in Google’s privacy policy: https://policies.google.com/privacy

Web analytics with Matomo

Our website uses the web analytics service Matomo to evaluate the use of our pages statistically and to improve them. Matomo runs on our own web server (analytics.minroc.de); the data is not passed on to third parties. Matomo does not set any cookies and does not store any information on your device. Among other things, it records the pages visited, date and time, browser, operating system, screen resolution and the page from which you came to us. Your IP address is shortened before it is stored, so that you remain anonymous to us as a user. If the “Do Not Track” setting is enabled in your browser, your visit is not recorded. The legal basis is our legitimate interest in analysing and improving our website (Art. 6(1)(f) GDPR).

If you do not agree to your visit being recorded, you can object at any time with a click below. In this case, a so-called opt-out cookie is stored in your browser, which instructs Matomo not to record your visits. If you delete your cookies, the opt-out cookie is deleted as well and may have to be set again.
